House Advances NDAA With AI Provisions

Summary

On September 10, 2025, the House passed chamber’s version of the fiscal year (FY) 2026 NDAA (H.R. 3838) via a 231-196 vote. The package does not include the Remote Access Security Act (RASA; H.R. 2683), the GAIN AI Act or the Chip Security Act (H.R. 3447/S. 1705). The measure does, however, include several AI amendments, including (1) Amendment 149, offered by Rep. Jim Himes (D-CT), which would require annual reporting on the U.S. Department of Defense’s (DoD) use of AI tools to modernize its business practices; and (2) Amendment 220, offered by Rep. Zach Nunn (R-IA), which would direct DoD to conduct an analysis of the tools currently available to combat the impact and threat of adversarial AI capabilities.
