James Tysse Named Litigator of the Week by The American Lawyer for Landmark DC Circuit Appellate Victory

Akin Supreme Court & appellate partner James Tysse has been named Litigator of the Week by The American Lawyer for securing a landmark victory in the U.S. Court of Appeals for the D.C. Circuit on behalf of Hesai Technology Co., Ltd., a global leader in 3D sensing technology for passenger and commercial vehicles.
The unanimous court reversed a district court decision and held, for the first time, that companies designated by the Department of Defense as “Chinese military companies” under Section 1260H are entitled to Fifth Amendment due process protections before those designations become final.
The decision addresses an issue of first impression and is the first appellate ruling recognizing that companies designated under Section 1260H are entitled to constitutional due process protections, establishing important precedent at the intersection of constitutional law, administrative law and national security.
In a Q&A with The American Lawyer, James discussed the case and its successful outcome, calling the victory “a gratifying result and a vindication of the client’s legal strategy.”
