FCC Votes to Reinstate Net Neutrality Rules

  • On Thursday, April 25, the FCC voted 3–2 to reinstate the Commission’s framework on net neutrality by reclassifying broadband internet access service as a Telecommunications Service, which is regulated under Title II of the Communications Act.
  • The Commission argued that this reclassification would provide “additional authority to safeguard national security, advance public safety, protect consumers, facilitate broadband deployment, and support broadband access.”
  • In connection with the reclassification, the Commission will impose new rules regarding treatment of broadband traffic and will forbear from applying many aspects of traditional utility regulation to broadband Internet access providers.
  • The new rules will take effect 60 days after the FCC’s Order is published in the Federal Register.
