LaborSpeak: Proposed Changes to New York Model Sexual Harassment Prevention Policy

In the latest installment of LaborSpeak, we provide a two-minute update on the New York State Department of Labor’s proposed revisions to its model sexual harassment policy.

on January 12th the New York State Department of Labor released proposed updates to its model sexual harassment prevention policy some updates to the model's sexual harassment prevention policy include a recognition that workplace harassment can take place when individuals are working remotely an increased focus on gender-based discrimination a new section on bystander intervention contact information for New York State's recently created confidential hotline for workplace harassment complaints and additional examples of sexual harassment

the public has 30 days until February 11th to comment on the proposed revisions before New York adopts a final version New York employers as these are only proposed updates you should not make any changes to your sexual harassment policies yet however New York state law requires employers to adopt the model policy or create a policy that equals or exceeds the minimum standards provided by the model policy once a final updated policy is adopted employers should review their own sexual harassment policies to make sure they meet the minimum standards of the updated model policy in line with any additional guidance that may be released for now employers should remember that all New York State employers are required to adopt written sexual harassment prevention policies and conduct annual anti-harassment trainings for employees feel free to contact our team if you have questions related to harassment discrimination and retaliation laws including updating policies and handbooks and conducting annual trainings for more information please reach out to a member of our labor and employment team [Music]
