Reuters has published an article titled, “The CFTC's enforcement year in review reveals dramatic shift” co-authored by white collar defense & government investigations senior counsel Jack Murphy and partners James Benjamin and Peter Altman. The article examines the Commodity Futures Trading Commission (CFTC) in 2025, evaluating the organization's structure, enforcement priorities and actions and expectations for 2026.  

The authors highlight that, “the agency's abrupt decline in enforcement activity was by design,” with the agency “overhauling the Division of Enforcement (DOE) and its docket, prioritizing guidance over enforcement actions, and focusing the agency's enforcement efforts on willful misconduct over technical and inadvertent compliance violations, noting that new leadership will likely “continue the light-touch enforcement approach of his predecessor.”
