Brady Dugan and Mollie McGowan Lemberg, partner and associate, respectively, in Akin Gump’s antitrust and unfair competition practice, wrote an article for Bloomberg BNA discussing how recent developments in Europe may put U.S. corporations at a disadvantage in cartel investigations. In the article, Dugan and McGowan argue that before a company decides to apply for leniency in Europe, which provides the benefit of a reduction in the amount of a corporate fine, it must consider the cost of having its own words used against it, not just in European damages actions, but also in U.S. courts.
