Reuters Legal has published an article, “What goes down comes back up: Federal agency enforcement actions drop and private enforcement class actions rise,” authored by Akin litigation senior counsel Caroline Wolverton. The article discusses the rise of class actions grounded in regulations as a result of federal agencies reducing enforcements activity. 

The article examines the cause and results of reduced federal agency enforcement actions with a focus on the increase in class actions alleging federal regulatory violations and the steps businesses can take to mitigate risks.  

Wolverton explains, “Plaintiff’s attorneys are looking to state consumer protection laws with causes of action that have been interpreted as broad enough to encompass claims grounded in federal law.”
