For its article “FCPA in Asia: ‘We’re not even getting called in for investigations’,” Global Investigations Review quoted Akin Gump Hong Kong-based litigation senior consultant solicitor Vena Cheng on the reported drop-off in cases involving foreign bribery attempts, particularly in matters involving investigations under the U.S.’s Foreign Corrupt Practices Act.
Cheng, whose practice focuses on defense in white collar and government investigations matters, said, “The Trump administration is more focused on international trade rather than criminal bribery matters.”
She also noted the possible role of the Chinese government’s crackdown on corruption, stating, “Once the [Chinese] government says ‘stop now’, everyone has either stopped or has made bribery so hard to detect that it’s hard for any company or government authority to investigate any type of bribery.”
Cheng noted, looking ahead, “There will still be investigations going forward, but it’s not going to be as crazy as the decade from 2006 to 2016.”
