Government Contracting Law Report Publishes Salcido Article on 11th Circuit FCA Liability Ruling

Government Contracting Law Report has published “11th Circuit’s Decision in AseraCare: Important in Determining When Clinical Judgment Regarding Medical Necessity Can Result in an Overpayment and How Evidence Regarding Corporate Knowledge Must Be Tied to Claims to Establish False Claims Act Liability,” an article by Akin Gump health care and life sciences partner Robert Salcido.

Salcido uses the article to discuss two common issues that arise in False Claims Act (FCA) litigation—“one specific to health care FCA litigation and one that cuts across all FCA actions involving corporate entities.” The ruling in United States v. AseraCare, he says, addresses both of these issues, with Salcido concluding that the case “is important in not only deterring the government from bringing these lawsuits, but also in providing guidance to health care entities regarding how to conduct internal medical reviews.”
