Akin Gump white collar defense and government investigations partner Ian McGinley spoke with Bloomberg Law about the issues surrounding unauthorized messaging by employees in the workplace as public companies face ongoing legal and regulatory risks of uncontrolled communication channels. The article “Smartphone Policing at Work Poses Risks, Fallout if Done Wrong” discusses the Department of Justice’s efforts in corporate control over employees’ business related chats on encrypted apps as well as the SEC’s look into asset manager’s use of outside messaging.

McGinley said “we’ve seen it with banks, but every single company has this issue. The SEC and regulators will be looking at other industries and questioning their practices,” and added, “We’re heading towards a regime where you need a technological solution or at least have tried one.”

McGinley served for more than a decade as Co-Chief of the Complex Frauds and Cybercrime Unit, and as a member of the Securities and Commodities Fraud Task Force, at the U.S. Attorney’s Office for the Southern District of N.Y.
