In WorldECR Article, Kevin Wolf Looks Ahead to Next 10 Years of Export Controls

WorldECR has published the article “Ten-year view: Export controls in 2031,” written by Akin Gump international trade partner Kevin Wolf. The article, coinciding with the publication’s 100th issue, looks at how export controls might evolve over the coming decade.

Wolf, a former Commerce Department official in the Obama administration, whom WorldECR describes as the “Architect of Export Control Reform,” writes that the system and the controls will likely “be very similar to those that exist today…because significant changes to complex systems involving serious issues where reasonable people can disagree are hard to accomplish.”

That said, Wolf lays out some predictions “for what will be relatively incremental, but still important changes in place by 2031.” They include:

  • The Bureau of Industry and Security (BIS) “will still be implementing a lightly amended Export Control Reform act of 2018.”
  • Export Administration Regulations “will control significantly more commercial [information and communication technologies] for human rights-related reasons.”
  • “BIS and the other agencies will have hired significantly more technical and economic experts in the emerging and foundational technology areas.”

The article concludes with Wolf noting that complexity is likely to increase, given the expected additions of new controls. As a result, he said, “government should look for every opportunity to simplify and streamline the system itself in order to enhance effectiveness and compliance, particularly for small- and medium-sized exporters.”
