Inside FERC Quotes Chip Cannon on Federal Power Act and Jurisdictional Issues

For its article “Better government coordination sought to sharpen power sector jurisdictional lines,” Inside FERC quoted Akin Gump energy regulation, markets and enforcement partner George “Chip” Cannon from his appearance at “Transforming the U.S. Electric System: Where Federal and State Initiatives Meet,” a daylong conference convened by The George Washington University Law School’s Sustainable Energy Initiative.
Cannon, who serves on the George Washington Energy Law Advisory Board, moderated the panel “Federal Initiatives,” which discussed the role that federal agencies and state governments can play in clarifying jurisdictional questions in the power sector. He noted that the Federal Power Act “has been remarkably flexible in responding to a changing industry” since its enactment 96 years ago and through multiple subsequent amendments.
Cannon also asked, “But are we getting to the point where we are far enough removed from the original vertically integrated model that it’s time to think about going into the [Act] and redrawing those jurisdictional boundaries so that they actually reflect the way the system operates?”
