Akin Gump litigation associate Josh Rubin has been quoted in the Los Angeles Business Journal article “Clippers Prep for a Different Court.” The article reports on a scheduled court date in January on a motion for summary judgment in a lawsuit seeking to block the Los Angeles Clippers from building a new arena in Inglewood, Calif.

The Madison Square Garden Company, the owner of the existing Forum arena in Inglewood, sued both the developer of the new arena as well as the city of Inglewood for fraud, claiming that the mayor had tricked it into turning over nearby land. MSG says it was told the land would be used for a technology park. It also argued that Inglewood agreed to limit similar venues after MSG acquired the forum in 2012.

Speaking of the suit, Rubin said there is, in fact, no radius clause or other smoking gun showing that the Inglewood mayor made any promises that a similarly sized venue would not be built near the Forum.
