The Washington Post has quoted Akin Gump international trade partner Kevin Wolf in the article “Biden expands Trump order by banning U.S. investment in Chinese companies linked to the military or surveillance technology.” The article reports on a new executive order that broadens prohibitions enacted during the Trump administration, while also moving authority for the ban to the Treasury Department from the Defense Department.

According to the article, the shift in jurisdiction will give the executive order stronger legal grounding. In addition, it says, the Treasury Department has more experience drafting sanctions programs.

Wolf, a former Commerce Department official in the Obama administration, agrees, telling the Post, “Treasury has a regulatory structure to list names and enforce prohibitions. Defense doesn’t.”
