For its article “New US Gun Export Rule Will Require Notice To Congress,” Law360 quoted Akin Gump international trade partner Kevin Wolf.
The article discusses a new Biden-Harris administration rule requiring congressional notice of exports of $4 million or more worth of semiautomatic weapons.
Wolf, a former Assistant Secretary of Commerce for Export Administration, Bureau of Industry and Security, said that arms sellers should see little change to their responsibilities when seeking an export license, with the exception of some deals perhaps taking longer to get approved.
Said Wolf, “It's an opportunity for breathing space for the administration and the interested members of Congress to have a discussion before a license is issued.”
According to Law360, the Commerce Department notice said exporters may still apply for licenses if they do not break up contracts to go under the $4 million threshold, and they may need to provide more documents in their application. Wolf, however, said that manufacturers already provide the information Commerce would now seek.
