For its article “CIT Tries To Get Its Arms Around 3,500 China Tariff Suits,” Akin Gump international trade partner Matthew Nicely was quoted as representing vinyl flooring supplier HMTX Industries LLC and lighting fixture supplier Jasco Product Co. LLC, companies whose lawsuits filed last year launched a wave of more than 3,500 lawsuits, to date, aimed at the Trump administration’s Section 301 tariffs on Chinese goods.
The article reports that the U.S. Court of International Trade (CIT) created a new master case, In Re Section 301 Cases, that will represent the claims of thousands of importers suing to recover duties they claim were imposed illegally by the Trump administration.
Nicely said that the companies are pleased with the creation of this master case as a first step. He added, “We think today's order establishing a master case will facilitate communications with the court for all parties and will clearly make the government's task of answering over 3,000 complaints much easier. We look forward to the court's response to the pending proposals for case management, which we assume will be forthcoming soon.”
