Akin Gump litigation partner Scott Heimberg has been quoted by Law360 in the article “How Construction Cos. Can Weather Another Gov’t Shutdown.” While the longest government shutdown in U.S. history is over, the article reports that construction contractors should take steps now to plan for any repeat in the future.

Among the precautions for construction companies to take, according to the article, is to review any contracts that could be affected if the government were to shut down again. This includes figuring out if one is required to continue working, what rights one has during such a situation and how they’re going to be paid. If a shutdown does happen and a contractor stops work on a project, Heimberg said it’s essential to keep track of expenses incurred during the closure.

“It’s really critical that companies track every penny of their costs that are related to what’s happening,” Heimberg said. “You may not be able to recover it all, but certainly if you don’t have records it’d be very difficult to recover it.”
