Marder and Rabbani Author Thomson Reuters Westlaw Article on COVID-19-Related Event Cancellation Class Actions

Thomson Reuters Westlaw has published the article “Event cancellations spawn a new wave of COVID-19 consumer class actions,” written by Akin Gump litigation partner Neal Marder and senior counsel Ali Rabbani. The article looks at some of the recent class action suits that have been filed concerning the refund policies companies have put in place for canceled or postponed events.

Marder and Rabbani suggest that companies in the live events industry “familiarize themselves with the terms and conditions of their consumer contracts to better understand their rights and obligations.” They also write that a well-drafted force majeure clause should be at the top of the list, as it could “excuse a party’s nonperformance under a contract when extraordinary events prevent it from fulfilling its contractual obligations.”
