For its article “As Feds Appeal Crypto Setback, Dearth of Regulation Strains US Market, Lawyers Say,” The National Law Journal quoted white collar defense and global investigations partner Parvin Moyne. The article examines differing opinions in a pair of crypto trading cases, with the cryptocurrency industry attempting to resolve one of its most complex questions—whether its issuers must register under federal law.

Regarding short-term takeaways, Parvin said, “If your company is under enforcement investigation, to see smart judges disagree, it could give the company the idea to fight it.”

“Settlement is usually the preferred outcome because of litigation costs, but now they could be thinking otherwise,” she added. “But [SEC. v. Terraform Labs] was only on a motion to dismiss while [SEC v. Ripple Labs] was summary judgment. It will be interesting to see if [Southern District of NY Judge] J. Rakoff finds the SEC can establish the facts needed.”
