The Washington Post has quoted Akin Gump international trade partner Kevin Wolf in the article “On eve of China summit, Biden administration subpoenas Chinese companies on possible security risks.” The article reports that in issuing the subpoenas, the Commerce Department is implementing an executive order signed by former President Donald Trump permitting the executive branch to prohibit the purchase of certain foreign-made goods that could pose national security risks.

According to the Post, the 2019 executive order comes into full effect this month after the publication of the implementing rules.

“The rule closes the circle at addressing threats to U.S. critical infrastructure by foreign telecom equipment that cannot be addressed by export controls, foreign direct investment controls, or procurement limitations,” said Wolf, a former senior Commerce official in the Obama administration.
