HB 0056: Idaho Restricts Public Construction Contracts From Being Awarded or Denied Based on ESG Standards

Summary

HB 0056 was enacted in February 2025 and becomes effective July 1, 2025.  It prohibits public construction contracts to be granted or denied "based on environmental, social, and governance standards."  Bids must may not be evaluated based on "subjective ethical or sustainability criteria unrelated to the specifications in a solicitation or the qualifications of a bidder."  Instead, the state must consider the bidder's prior experience with the state, past performance, workmanship and timeliness, and safety record, among other qualities.
