SB 129: Alabama Limits DEI Programs in State Agencies and Universities

March 20, 2024

Summary

SB 129 was passed in March 2024 and limits diversity, equity, and inclusion (DEI) efforts of state agencies, public universities, and public boards of education. State entities may not maintain any office, location, or department that promotes DEI programs, and no student, employee, or contractor may be required to participate in any DEI program, training, or course work that promotes "divisive concepts" based on race, color, religion, sex, ethnicity, or national origin. The law also requires public higher education institutions to designate bathrooms based on biological sex, which is defined under Ala. Code § 16-1-54 to be the sex stated on an individual's birth certificate.
