SB 205: Kentucky Maintains List of Companies that Boycott Fossil Fuels

Summary
SB 205, enacted in April 2022, requires the Kentucky state treasurer to maintain and publish a list of financial companies that they believe are boycotting energy companies that deal in fossil fuels. Companies on the list are issued warnings and the state then creates a path for government entities to divest from said companies.
The law defines an "energy company boycott" to mean "without an ordinary business purpose, refusing to deal with, terminating business activities with, or otherwise taking any action that is intended to penalize, inflict economic harm on, or limit commercial relations with a company" because that company engages in the fossil fuel-based energy industry and does not commit to meet environmental standards or because the company does business with such a company.
