SB 409: Arkansas Prohibits Financial Service Providers From Discriminating Against Agricultural Producers

Summary

SB 409 was enacted in March 2025 and prohibits financial service providers from discriminating against "agricultural producers."  The Act defines agricultural producers as "a natural person or company engaged in the production of goods derived from plants or animals," like growing crops, animal husbandry, and the production of livestock or dairy products.  "Agricultural producers" join the list of other industries financial institutions may not discriminate against in the ESG context, including the firearm, ammunition, fossil fuel, or energy industries.
