SB 62: Arkansas Bans Government Contracts with Companies that Boycott the Fossil Fuel, Firearms, or Other Industries

Summary

SB 62 was enacted in April 2023 and prohibits state or local government entities from entering into contracts with companies engaged in boycotts of energy, fossil fuels, firearms, or ammunition industries. Additionally, the law prohibits state or local government entities themselves from engaging in such boycotts. 

The law defines "boycott" to mean refusing to deal, terminating business activities, or taking other action to limit relations with the industries in a discriminatory manner and "without an ordinary business purpose." The law further defines "ordinary business purpose" to mean "a purpose that is related to business operations" and states that it "does not include a purpose that is solely related to furthering social, political, or ideological interests."
