SB 700: Florida Prohibits Financial Institutions From Discriminating Against Agricultural Producers

Summary

SB 700 was enacted in May 2025 and prohibits financial institutions from discriminating against agricultural producers based on ESG factors.  The Act defines "agricultural producer" as a person or company "engaged in the production of goods derived from plants or animals, including, but not limited to, the growing of crops, silviculture, animal husbandry, or the production of livestock or dairy products." Specifically, financial institutions may not refuse to provide services, terminate or restrict services based on the producer's greenhouse gas emissions, use of fossil-fuel derived fertilizer, or fossil-fuel powered machinery.
