Biography
  • Concentrates his practice on corporate restructurings in Chapter 11 cases and out-of-court restructurings.
  • Seventeen years of experience advising on restructurings across all industries, with a particular focus on retail and energy.

Arik Preis represents informal and official committees of creditors, debtors, individual creditors, rights offering backstoppers, and lenders in in-court and out-of-court restructurings. He has also represented lenders and administrative agents in connection with non-restructuring-related loans, including leveraged loan transactions, mezzanine financings and more traditional loans.

Arik’s work extends to the representation of creditors in the analysis of all types of debt documents and capital structures.

  • Purdue Pharma: Counsel to the Official Committee of Unsecured Creditors in the chapter 11 cases of Purdue Pharma and its affiliates, the privately held pharmaceutical company and maker of OxyContin, involving over a trillion dollars of asserted claims.
  • Mallinckrodt: Counsel to the Official Committee of Opioid Related Claimants in the chapter 11 cases of Mallinckrodt and its affiliates, an American-Irish pharmaceuticals company, involving hundreds of billions of dollars of asserted claims. Restructuring of the Year (The Deal).
  • HONX: Counsel to the Official Committee of Unsecured Creditors in the chapter 11 case of Honx, a subsidiary of Hess Oil, that owned and operated a refinery in the U.S. Virgin Islands, involving hundreds of millions of dollars of potential asbestos liabilities.
  • Endo International: Counsel to the Official Committee of Opioid Claimants in the chapter 11 cases of Endo International and its affiliates, an American-Irish generics and specialty branded pharmaceutical company, involving hundreds of billions of dollars of asserted claims.
  • Insys Therapeutics: Counsel to the Official Committee of Unsecured Creditors in the chapter 11 cases of Insys Therapeutics and its affiliates, an American specialty pharmaceutical company, involving nearly $1 billion in liabilities.
  • Achaogen: Counsel to the Official Committee of Unsecured Creditors in the chapter 11 case of Achaogen, a biopharmaceutical company developing and commercializing innovative antibacterial agents, involving $120 million in liabilities. Cross-Border M&A Deal of the Year – Below $50M (Turnaround Atlas Awards).
  • Pernix: Counsel to the Official Committee of Unsecured Creditors in the chapter 11 cases of Pernix Therapeutics and its affiliates, a specialty pharmaceutical company. Chapter 11 Reorganization of the Year – $50M to $100M (M&A Advisor).
  • Hertz: Counsel to an ad hoc group of second lien noteholders in the chapter 11 cases of Hertz and its affiliates, an international car rental company, involving $19 billion in liabilities. Restructuring Deal of the Year (IFLR).
  • SunEdison: Counsel to an ad hoc group of second-lien lenders, rights offering backstoppers and DIP financing lenders in the chapter 11 cases of SunEdison and its affiliates, a renewable energy company, involving $16.1 billion in liabilities. Restructuring of the Year – Over $5 billion (M&A Advisor).
  • Nine West: Counsel to the Official Committee of Unsecured Creditors in the chapter 11 cases of Nine West and its affiliates, an American online fashion retailer, involving $1.6 billion in prepetition funded debt. Deal of the Year (PETITION).
  • Mission Coal: Counsel to the prepetition first lien lender and the debtor in possession financing lender in the chapter 11 cases of Mission Coal and its affiliates, an Alabama-based coal mining company, involving $175 million in liabilities.
