Biography

Daniel Witkowski focuses his practice on international trade remedies and customs. Dan represent governments and companies in antidumping (AD) and countervailing duty (CVD) proceedings before the U.S. Department of Commerce and the International Trade Commission, and in appeals before the U.S. Court of International Trade (CIT), the U.S. Court of Appeals for the Federal Circuit and NAFTA binational review panels.

He assists companies seeking exclusion requests and providing comments under Section 301 of the Trade Act of 1974.

Dan represents and advises companies regarding classification, valuation, penalties and other issues before U.S. Customs and Border Protection.

Dan was a law clerk to the Hon. Jane A. Restani of the U.S. Court of International Trade from 2013–2015, where he worked on trade remedies and customs issues. He served as a legal extern in the Office of the Assistant Legal Advisor for International Claims and Investment Disputes at the U.S. Department of State from 2012–2013. Dan was also a law clerk in Amtrak’s Law Department.

Active in pro bono matters, Dan has experience with immigration proceedings, including asylum claims and applications for U-Visa.

Representative Work
  • Represented the Government of Canada in the Softwood Lumber proceedings before the U.S. Department of Commerce and NAFTA binational dispute panels.
  • Represented the Government of Canada in the Uncoated Groundwood Paper CVD proceeding before the Department of Commerce.
  • Represented a major German manufacturer of lightweight thermal paper in appeals of Department of Commerce AD duty determinations before the U.S. Court of Appeals for the Federal Circuit.
  • Represented Vietnamese shrimp producers in the appeal of U.S. Department of Commerce AD duty administrative review before the CIT and in administrative reviews before the Department of Commerce.
  • Represented a Japanese producer of cut-to-length carbon and alloy steel plate in its appeal of the ITC’s injury determination.
  • Represented the Government of Canada in the NAFTA appeal of the Department of Commerce’s determination in the Supercalendered Paper CVD proceeding and in the expedited and administrative reviews of the CVD order before the Department of Commerce.
  • Represented importer in appeal of U.S. Customs and Border Protection’s classification of chemical compound before the CIT and U.S. Court of Appeals for the Federal Circuit.
  • Represented Vietnamese shrimp producer in appeal of Department of Commerce AD duty determination before the U.S. Court of Appeals for the Federal Circuit.
  • Represented and advised tires retailer and wholesaler in AD/CVD proceedings.
