Biography
  • Focuses on advising clients on a wide range of financial restructuring matters.
  • Provides counsel on in- and out-of-court restructurings and strict foreclosures, including on complex matters involving bondholder committees and creditors’ committees.
  • Clients include debtors, official and unofficial committees of unsecured creditors, secured lender groups, DIP lenders, institutional investors, investment funds, and acquirers of businesses and assets.

Kate represents debtors, creditors, official and unofficial committees, secured lender groups, debtor-in-possession (DIP) lenders, institutional investors, alternative investment management firms and other parties on a wide range of complex financial restructuring matters.

Kate assists clients on in- and out-of-court restructurings and strict foreclosures across industries, including traditional and renewable energy, health care & life sciences, media & entertainment, investment management & private equity, retail and technology.

Kate served from 2011 to 2012 as a law clerk to the Honorable Barbara J. Houser, U.S. Bankruptcy Court for the Northern District of Texas.

Earlier in her career, Kate practiced in the New York office of another leading international law firm.

  • Rite Aid: Counsel to the Official Committee of Tort Claimants in connection with the chapter 11 cases of Rite Aid Corporation, a Fortune 500 public company and one of America’s largest drugstore chains.
  • Endo International: Counsel to the Official Committee of Opioid Claimants in the chapter 11 cases of Endo International and its affiliates, an American-Irish generics and specialty branded pharmaceutical company, involving hundreds of billions of dollars of asserted claims.
  • Yak Access: Counsel to an ad hoc group of existing first lien term loan lenders in the completion of a major recapitalization of Yak Access, a leading provider of temporary access roads and related services, led by its principal equity holder, Platinum Equity.
  • HONX: Counsel to the Official Committee of Unsecured Creditors in the chapter 11 case of HONX, a subsidiary of Hess Oil, that owned and operated a refinery in the U.S. Virgin Islands, involving hundreds of millions of dollars of potential asbestos liabilities.
  • Intelsat: Counsel to an ad hoc group of creditors in the chapter 11 cases of Intelsat and its affiliates, one of the largest satellite services providers in the world, involving $14.7 billion in liabilities. Restructuring of the Year – Over $10 billion (M&A Advisor).
  • FirstEnergy Solutions: Counsel to the debtors in the chapter 11 cases of FirstEnergy Solutions and its subsidiaries, an electric utility that services roughly one million residential, commercial and industrial customers, involving $3.8 billion in liabilities.
  • Talen Energy: Counsel to an ad hoc group of first lien creditors in the chapter 11 cases of Talen Energy and its affiliates, one of the largest power generation and infrastructure companies in North America, involving $4.455 billion in liabilities. Successful Restructurings of the Year (Turnarounds & Workouts).
  • Frontera: Counsel to the first lien lenders in the chapter 11 cases of Frontera Holdings and its affiliates, owner of the only U.S.-based power plant that sells all of its power to Mexico, involving $944 million in liabilities. Mid-Size Company Turnaround/Transaction of the Year Award (TMA).
  • Brooks Brothers: Counsel to the Official Committee of Unsecured Creditors in the chapter 11 cases of Brooks Brothers and its affiliates, the oldest apparel brand in the United States. Consumer Discretionary Deal of the Year (Over $500 million) (M&A Advisor).
  • Weatherford International: Counsel to the ad hoc noteholder committee in the multijurisdictional cases of Weatherford International and its affiliates, one of the world's largest oilfield services firms, involving $8.3 billion in liabilities. Large Energy Restructuring of the Year (Turnaround Atlas Awards).
  • Jonah Energy: Counsel to an ad hoc noteholder group in the $1.3 billion out-of-court restructuring of Jonah Energy, one of the largest privately held natural gas producers in the U.S.
  • Salt Creek Midstream: Counsel to an ad hoc group of holdco lenders with respect to investments in Salt Creek Midstream and its affiliates, one of the largest privately-owned crude oil gatherers in the Delaware Basin.
  • Millennium Health: Counsel to Millennium Health, a leading provider of laboratory-based diagnostics focused on drug abuse and clinical medication monitoring, in its out of court restructuring.
