Bloomberg BNA Publishes Akin Gump Article on Independent Monitors

Mark MacDougall and Connor Mullin, partner and counsel, respectively, in the litigation practice at Akin Gump, have authored the article “Independent Monitorships and Corporate Reputation,” which was published in Bloomberg BNA’s White Collar Crime Report.

The article discusses the ramifications of hiring an independent monitor and the steps organizations should take before doing so. MacDougall and Mullin write that while “the rise of the reputational monitorship is unmistakable” in the wake of such scandals as those involving Penn State University and Jerry Sandusky or General Motors and its widespread ignition switch defect, hybrid legal engagements “in which a law firm is hired by an organization to conduct an independent investigation or serve as a monitor—may not ultimately serve the goal of preserving corporate reputation.”
