CCBJ Publishes Akin Gump Article on Workplace COVID-19 Vaccination Policies

Corporate Counsel Business Journal has published the article “The COVID-19 Vaccine Rollout: What Employers Need to Know,” written by Akin Gump labor and employment partner Gary McLaughlin and counsel Josh Sekoski. The article, adapted from an Akin Gump client alert, addresses some key questions regarding mandatory and voluntary vaccination policies.

The authors begin by stating that employers may require that employees get vaccinated, “subject to exceptions under antidiscrimination laws.” McLaughlin and Sekoski then look at how both the Americans with Disabilities Act and the Pregnancy Discrimination Act apply to mandatory vaccination policies. They also address what to do if an employee objects to vaccination on religious or philosophical grounds.

The article concludes with a discussion of whether employees are entitled to reimbursement for mileage or other transportation costs incurred in getting vaccinated, and if employees need to be paid for time spent getting vaccinated.
