Law360 quoted Akin Gump energy regulatory partner Chip Cannon Jr. for its article “3rd Circ. Leaves State Power Subsidies In No Man's Land,” on a recent circuit court ruling that state subsidies for new power generation overlap the Federal Energy Regulatory Commission’s authority over electricity markets.

Cannon said that the 3rd Circuit did not address states’ options in fostering new power development: “I think that those decisions will be informative as policymakers sort through how closely they can get to the line. But fundamentally, that gray area still exists. I don't think that this [latest] decision provides any more clarity."
