Law360, in its article “7th Circ. Ruling Fortifies FERC’s Transmission Rule,” quoted Akin Gump energy regulation, markets and enforcement partner Chip Cannon regarding the June 7 decision by a 7th Circuit panel affirming most of the Federal Energy Regulatory Commission’s 2010 orders concerning a Midwest Independent Transmission System Operator Inc. tariff to fund construction of high-voltage power lines.

Cannon, commenting on how this decision supports FERC’s view that developers of regional projects can distribute the cost burden across the region, said, “I was really struck with the ease in which the court seemed to accept the premise that these facilities provide benefits on a regionwide basis. I think the court's decision is reflecting the reality of what today's grid is like, how it's built out and what's needed [to improve it].”
