Chip Cannon Quoted in Inside FERC on Nominees to Restore FERC Quorum

Akin Gump energy regulation, markets and enforcement partner Chip Cannon was quoted in Inside FERC for its article “Trump formally nominates Chatterjee, Powelson; Senate timing still uncertain,” on a timeline for the Federal Energy Regulatory Commission to regain a quorum of commissioners.

Cannon said he anticipated Senate action on the President’s nominees by the July 4 recess, noting that the nominees are known figures: “It’s safe to say that everybody in the energy bar is happy about moving to a quorum and getting FERC back up to fully functioning, and getting orders to provide more certainty for the industry.”

He added, however, that, even assuming that FERC regains a quorum, the backlog of orders awaiting the commission could take until autumn or even later to work through. Cannon also noted that the commission would have to triage the orders, as some may have statutory requirements, while, in other cases, transactions may be waiting for the orders in order to close.
