In its article “U.K. Court to Decide Brexit’s Next Chapter,” Financial Technologies Forum has quoted Akin Gump international trade partner Davina Garrod about the appeal by the British government of a U.K. High Court ruling, which said that Prime Minister Theresa May does not have the power to start E.U. departure proceedings without the prior authority of Parliament.

The U.K. Supreme Court has set the appeal for December 5 with all 11 justices expected to hear the case—the first time that has happened. While Garrod noted that the High Court judges ruled to uphold “the fundamental principle of Parliamentary Sovereignty,” she added that a successful appeal in December “looks unlikely given the seniority, expertise and experience of the first instance judges.”
