In Daily Journal Article, Heinke and Nalchajian Preview Supreme Court Cases on Employment Protections for LGBTQ+ Employees

Rex Heinke, co-head of the Supreme Court and appellate practice at Akin Gump, and Jenna Nalchajian, a litigation associate at the firm, have written the article “What is discrimination because of ‘sex’?” for the Daily Journal. The article previews three cases before the U.S. Supreme Court this Term that will determine the scope of employment protections for LGBTQ+ employees under Title VII of the Civil Rights Act of 1964.

The question presented in the cases, Heinke and Nalchajian write, is whether discrimination on the basis of sexual orientation and gender identity are prohibited by law. It is of critical importance, they say, “to millions of LGBTQ+ Americans for whom Title VII would be the only legal prohibition of such employment discrimination.”
