The Journal of Robotics, Artificial Intelligence & Law has published the article “Automated Vehicles 3.0: Preparing for the Future of Transportation,” written by Susan Lent, a partner in Akin Gump’s litigation practice and co-leader of the firm’s autonomous vehicles (AV) initiative, and Ashley Brown, counsel in the firm’s intellectual property practice.

The article summarizes the Department of Transportation (DOT)’s “AV 3.0,” guidance on the testing and deployment of vehicles equipped with autonomous driving systems, which, the authors write, “focuses on how automation will be safely integrated across passenger vehicles, commercial vehicles, on-road public transportation, and the roads on which they operate.”

Lent and Brown first describe various DOT programs and policies in ensuring the safe integration of AVs into the nation’s transportation system. They then outline some of AV 3.0’s best practices for state, local and tribal governments; state legislatures; and state highway officials.

The article turns next to key considerations for infrastructure owners and operators, state commercial vehicle enforcement agencies, the public transit industry and local governments. It also addresses the issue of cybersecurity threats, for which the guidance recommends, “that state, local and tribal governments invest in improvements to cyber defenses and infrastructure to protect critical infrastructure.”
