Thomson Reuters Westlaw has published “MedTech update 2020 — Legal and regulatory issues to watch for in the medical technology industry in the new year: Health information privacy and data protection.” The article, which originated as part of a longer Akin Gump client alert, was written by health care and life sciences senior counsel Jo-Ellyn Sakowitz Klein, associates Mallory Jones, Rachel Kurzweil and Caroline Kessler and public policy specialist Taylor Daly.

The article examines some of the issues that could affect health information privacy and data protection in 2020, with the authors observing that they could all have “a substantial impact on medtech operations (including research and development), compliance activities and transactions.”

One of the biggest issues to watch in the coming year, the authors write, pertains to Health Insurance Portability and Accountability Act (HIPAA) regulations, “which have been the dominant force in the health information privacy and data protection landscape since the interim final HIPAA privacy rule was promulgated in 2000.” They also expect developments at the state level, where different legislatures “jumping into the privacy law space will add to the existing patchwork of state law requirements for health care entities, including medical device companies.”
