Law360 has published the article “FERC Proposal A Lift For New Energy Technologies,” written by Suedeen Kelly, partner and chair of the energy regulation, markets and enforcement practice at Akin Gump, senior counsel Jeffery Dennis and associate J. Porter Wiseman.

The article examines a recent Notice of Proposed Rulemaking (NOPR) by the Federal Energy Regulatory Commission, which, the authors write, “represents a major step forward in efforts to integrate energy storage and distributed energy resources (DERs) into wholesale electricity markets.” Kelly, Dennis and Wiseman discuss the legal basis for removing barriers to entry facing energy storage and DERs. They also address the creation of a new participation model for energy storage. Finally, the article previews what is ahead, noting that comments on the NOPR are due January 30, 2017.
