Law360 has published the article “Bucking The Trend With Rule 9019 Settlements” by Arik Preis, a New York-based partner in Akin Gump’s financial restructuring practice.

Illustrated by three recent examples of these Rule 9019 settlements, the article discusses how, via Bankruptcy Code Sections 363 and 105, prepetition unsecured creditors can receive cash (or other currency) settlements from debtors upon approval of the settlement instead of the effectiveness of the plan.
