Paul Gutermann, who heads Akin Gump’s environment and natural resources practice, was quoted by Law360 in its article “BP Spill Plaintiffs May Struggle To Show Economic Losses.”

Discussing the road ahead for thousands of plaintiffs suing BP PLC for economic losses they allege are a consequence of the 2010 Deepwater Horizon incident, Gutermann noted, “The most basic challenge for plaintiffs, which is one of the strongest defenses for BP and other similar defendants, is to prove that the acts or omissions of BP caused the economic loss claimed. There are any number of additional causes for economic losses, with the recession being a major one.”
