Law360 has published “Proposed Law Could Breathe New Life Into Section 4(a)(5),” written by Akin Gump corporate partner Alice Hsu, senior counsel Tracy Crum and associate Chase Mechanick.

The article, which originated as a post on the AG Deal Diary blog, discusses the Fair Investment Opportunities for Professional Experts Act, legislation that would broaden the definition of “accredited investor” under the Securities Act of 1933 “to include licensed brokers, investment advisers and other individuals with educational or professional expertise.” The authors write that the bill, if passed, would result “in a large number of corporations and other entities also qualifying as accredited investors.”
