Leading Health Industry Attorney Authors Treatise on False Claims Act and the Health Care Industry

(Washington, D.C.) – Leading health industry attorney Robert S. Salcido, a partner at Akin Gump Strauss Hauer & Feld LLP, has authored the just-released False Claims Act & the Healthcare Industry: Counseling & Litigation, Second Edition (American Health Lawyers Association 2008).

In the nine years since AHLA published the first edition of this authoritative guide, the government has continued to negotiate major settlements against health care entities under the False Claims Act, and the courts have issued numerous decisions that impact the manner in which health care businesses are organized and operated. In 2006 alone, the federal government recovered more than $3.1 billion in settlements and judgments under the federal FCA; 72 percent of those recoveries occurred in the health care industry. In addition, Congress has provided substantial financial incentives to states to promulgate their own false claims act legislation.

The new edition of this guide provides attorneys with the information they need to more effectively advise clients on how to assess their companies’ potential exposure to liability, evaluate the exposure of companies that they may acquire, and reform their companies’ practices to reduce the risk of potential FCA liability.

A former Department of Justice trial attorney, Robert Salcido represents Fortune 500 companies and major nonprofit health care systems in responding to governmental investigations, conducting internal investigations, defending lawsuits filed under the False Claims Act and defending wrongful retaliation lawsuits brought by alleged whistleblowers. He also provides counseling regarding the application of health care fraud and abuse laws.
