Mary O’Connor and Patrick O’Brien, partner and counsel, respectively, in Akin Gump’s litigation practice in Dallas, wrote an article for Bloomberg BNA’s Securities Regulation & Law Report on the structure of typical SEC settlements with public companies and their officers and directors. In “Chinks in the Enforcement Armor: Recent Decisions Erode SEC’s Favored Remedies,” O’Connor and O’Brien cite three cases in which courts rejected the settlements and analyze the potential impact of those rulings for future settlement strategies.
