Michael Asaro Discusses Best Practices for Data Preservation with The FCPA Report

The FCPA Report quotes Michael Asaro, a partner in Akin Gump’s white collar defense and corporate investigations practice, in the article “Strategies for Preserving Data Before and During an FCPA Investigation.”

Asaro notes that government prosecutors will often “rely on an internal investigation done by reputable counsel and give companies credit for that.” Failure to preserve key documents, he warns, could shatter any goodwill with regulators.

On the subject of companies instituting a data retention policy, Asaro adds that, by deleting emails and other documents too early, “you will be severely hampered in conducting your own internal investigation.”
