Michael Kahn Speaks with Medtech Insight for Q&A on Impact of IP Law on Digital Medtech Industry

Akin Gump intellectual property partner Michael Kahn spoke with Medtech Insight for the Q&A article “Digital Medtech Will Help Shape Future IP Law”—a conversation addressing how intellectual property law has evolved in recent years and how it might affect the digital medtech industry.

Kahn said he expects digital medtech companies to play a major role in continuing to shape intellectual property in the future. He noted that “divided infringement,” an area of IP case law that emerged in the mid-2000s, has important bearings for the digital medtech industry—not just for technology, but also for methods used in a product.

As examples of cases that have greatly affected the evolving area of IP, Kahn cited the Supreme Court case Akamai v. Limelight where the issue of divided infringement came to an apex. He also referenced McKesson v. Epic, a digital medtech case involving software and systems that provided automated communication between healthcare providers and patients.
