Pratik Shah, co-head of Akin Gump’s Supreme Court and appellate practice, was quoted in The New York Times article  “Right Divided, a Disciplined Left Steered the Supreme Court,” discussing the Supreme Court term that just ended.

The article notes that in many cases, including last week’s decisions involving the Affordable Care act and same-sex marriage, the Court’s four-member “liberal wing,” all appointed by Democratic presidents, managed to “pick off” one or more votes from the five “conservative” justices, all appointed by Republicans.

In a surprise to many, Shah noted, the Obama administration found an unlikely ally in the Court in major cases this term. “Not many imagined a few years ago,” he said, “that this court, rather than Congress, would become the more effective venue for furthering the administration’s priorities.”
