Public Utilities Fortnightly Publishes Akin Gump Article on New FERC/CFTC Information Sharing

Steven Reich and Charles Connolly, partners in the investigations practice at Akin Gump, and Porter Wiseman, senior attorney in the firm’s energy regulation, markets and enforcement practice, have written the article “Enforcement Times Two” for Public Utilities Fortnightly, which examines increased cooperation between the Federal Energy Regulatory Commission and the Commodity Futures Trading Commission following the issuance of memoranda of understanding that cover issues of jurisdiction and information sharing.

The article discusses how this recent development, along with a closer working relationship between the two commissions, will affect their increasingly aggressive pursuit of alleged cases of market manipulation and heighten “the enforcement risk for companies engaged in trading physical and financial energy products.” It also looks at collaboration by the commissions with other government agencies, particularly the Department of Justice, and private plaintiffs.
