Law360, for its article “5 Serious Tips To Get The Most Out Of A Mock Trial,” quoted Akin Gump litigation partner Reg Steer on the benefits of mock trials while attorneys prepare and test their argument before presenting it to a jury in a high-stakes case.

In a mock trial, attorneys have the ability to view the jurors’ deliberation to determine the quality, clarity and viability of their argument, which Steer says has been the most educational part of the case. He added, “The most frightening thing is to see people rationalize their gut sense with which they left the mock courtroom.”

Among other topics, he discussed the importance of attorneys being flexible with their presentation plans and emphasis as well as the benefits of using a team member to “play” a witness, instead of a video recording of the witness’ deposition, in order to get the most effective results from a mock trial experience.
