Akin Gump appellate practice co-head Rex Heinke spoke with Law360 about a Supreme Court case addressing whether plaintiffs’ attorneys can use records from driver’s licenses to find potential clients for class actions.

Heinke says the sensitive nature of the information at issue could make the Supreme Court “reluctant to broadly interpret the litigation exception [of the Driver’s Privacy Protection Act] in a way that would allow a lot of confidential information to be available to anyone in litigation that involves automobiles.”
